Welcome to Oorzza Megacorp! These Terms and Conditions (“Terms”) govern your use of the Oorzza Megacorp e-commerce website and mobile application (collectively, the “Oorzza”) in India.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use immediately.

1. General Conditions

The Site is intended for users who are at least 18 years old and capable of forming a binding contract under Indian law (Indian Contract Act, 1872). By using the Site, you represent and warrant that you meet this eligibility requirement.

2. Products, Pricing, and Orders

2.1. Product Information

We strive to ensure all product information, including descriptions, prices, and images, is accurate. However, we do not warrant that product descriptions or other content are error-free, complete, or current. Colors may vary slightly due to your device display settings.

2.2. Pricing and Payment

• All prices displayed on the Site are in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST), unless otherwise stated.

• We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order).

   

   

• We accept various forms of payment, including credit/debit cards, Net Banking, UPI, and Cash on Delivery (COD) in select locations.

   

2.3. Order Acceptance

Your order constitutes an offer to purchase. Order confirmation (electronic or otherwise) does not signify our acceptance, nor does it constitute a confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason, including product unavailability, error in pricing, or detection of fraudulent activity.

3. Shipping, Returns, and Refunds

3.1. Shipping and Delivery

• We aim to deliver products within the stipulated time frame mentioned on the product page. Delivery times are estimates only and are not guaranteed. Oorzza Megacorp is not liable for delays caused by logistics partners or circumstances beyond our control.

• Title and risk of loss for all products ordered pass to you upon our delivery to the shipping carrier.

3.2. Governing Policy

All aspects related to returns, replacements, and refunds are governed by our separate Refund, Returns, and Replacement Policy, which is incorporated into these Terms by reference. By purchasing from us, you agree to that policy.

4. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, product names, and software (collectively, “Content”) is the proprietary property of Oorzza Megacorp and is protected by Indian and international copyright and trademark laws. You may not use any Oorzza Megacorp trademarks or Content without express written permission.

5. Limitation of Liability and Indemnification

5.1. Limitation of Liability

To the maximum extent permitted by law, Oorzza Megacorp will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or the products purchased, regardless of the cause of action. In no event shall our total liability exceed the amount paid by you for the specific product giving rise to the claim.

5.2. Indemnification

You agree to defend, indemnify, and hold harmless Oorzza Megacorp, its affiliates, and their respective directors, officers, and employees from and against any claims, damages, costs, and expenses (including legal fees) arising from your breach of these Terms or your use of the Site.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any dispute or claim relating in any way to your use of the Site or to any products or services sold or distributed by Oorzza Megacorp shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of the arbitration shall be Dehradun.

7. Amendments

We reserve the right to change, modify, or update these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Site. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.
